Citizens of Hong Kong and Macau approved to set up
individu
ally-owned stores in Qingdao, to include retail and restaurants
According to the Supplemental Agreement of the CEPA, as of this year,
citizens of Hong Kong and Macau can apply for individually-owned Business
Licenses in the Chinese mainland. The Industrial & Commercial Administration
of Qingdao has recently opened a dedicated window and "Green Passage" in the
Registration Hall for dealing with such applications.
In accordance with the aforementioned regulations, as of January 1, 2005,
permanent citizens of the Hong Kong and Macao SARs are allowed to set up
individually-owned stores through legal registration with the Industrial &
Commercial Administrative Management Department, without being subject to the
approval procedures applicable to foreign investments. The business scope
covered by the new regulation covers retail (not including alcohol and tobacco),
catering, hair dressing, health and beauty services, bath houses, and repair
services for home electrical appliances and other goods.
The makeup of such individually-owned enterprises, however, is limited to
the individual; partnership or family operations are not covered for under this
regulation. It is also required that the number of employees of any such
business should be no more than 8 and that the store area should not be more
than 300m2. Applicants should go directly to the Industrial & Commercial
Department to register with their identification card, documents verifying
identity and other related documents. The Industrial & Commercial Department
provides one-stop application, processing and approval services, and given that
necessary documents are in order, business licenses are issued immediately. In
addition, "Hong Kong citizen" or "Macao citizen" will be appended to the
license.
According to our understanding, Qingdao will borrow from the experience and
practices of Guangdong province, and adapt it practically to Qingdao's situation
and modified software for enterprise registration. Qingdao's application
procedure will be implemented in 3 phases: in the first phase, before the end of
2005, applicants should register with the Industrial & Commercial Bureau of
Qingdao; the second phase, beginning January 1, 2006, registration will be
turned over to sub-branches of Qingdao Industrial and Commercial Bureau, and in
the end registration could be field in different Industrial & Commercial
district stations.
It is reported that, since January 1, 2005, the Industrial & Commercial
Bureau has received many consultative phone calls from Hong Kong and Macao
citizens over this matter. They have promised to take into special consideration
the differences in written and spoken languages of Hong Kong and Macao citizens
to assist applicants that meet with any difficulties during the application

根据内地与香港、澳门特区政府签署的补充协议有关规定,从今年开始,港澳居民也可以在内地申办个体工商户营业执照了。近日,工商系统有关机构已在注册大厅设立了港澳居民申办个体工商户的专门窗口和"绿色通道"。
据了解,按照规定,自今年1月1日起,香港、澳门永久居民中的中国公民可以在内地设立个体工商户,无需经过外资主管部门审批,由工商行政管理部门依法登记。港、澳居民可以申请登记的经营范围包括:零售业(不包括烟草零售)、餐饮业、居民服务业和其他服务业中的理发及美容保健服务、洗浴服务、家用电器修理及其他日用品修理等。
申办个体工商户的组成形式仅限于个人经营,不能采用合伙经营或家庭经营等方式,其从业人员不得超过8人,经营场所面积不得超过300平方米。申请人凭身份证件、身份核证文件,以及其他相关材料,即可直接到工商部门申请登记,工商部门将提供申请、受理、审批一站式服务,符合条件的当场予以登记,在营业执照上加注"香港居民"或"澳门居民"字样。
据了解,根据广东地区先行登记的经验和实践,结合我市实际和登记软件修订情况,我市港、澳个体工商户登记工作拟分三步走。第一步,在2005年底以前,所有港、澳居民在我市申办个体工商户登记,均由市局负责登记管理并进行统计综合;第二步,自2006年1月1日开始,相关登记工作移交分局负责,纳入正常登记、管理范畴;第三步,待条件成熟,逐步委托辖区工商所登记。
据悉,自1月1日至今,工商部门已接到不少港澳人士的咨询。为保障工作质量,工商部门将特别注意港澳居民在语言和文字使用上与内地居民的差异,热心帮助港澳居民解决登记过程中的实际困难。
